PHOTOGRAPHY Contract

Thank you for choosing Red’n’Dead Photography. There’s just a little housekeeping to make sure everything runs smoothly.

Please carefully read the following terms and complete the form to digitally sign.

THIS AGREEMENT is between Red’n’Dead Photography (“The Photographer”) and You (“The Client”).

1. DEPOSIT AND PAYMENT

In consideration for the services provided by the Photographer, the Client agrees to pay the full amount quoted. A non-refundable initial payment to be agreed before is due upon signing this contract. This secures the booking date and time and is not considered a deposit.

The remaining balance is due no later than 7 days prior to the scheduled shoot date.

2. CANCELLATION POLICY

If the Photographer cancels for any reason, all monies paid will be refunded in full within 7 working days.

If the Client cancels the session for any reason, the initial payment will not be refunded.

Failure to pay the remaining balance at least 7 days prior to the session will be considered cancellation by the Client, and the Photographer reserves the right to cancel the session and retain the initial payment.

3. RESCHEDULING

If the Client requests to reschedule, the initial payment will be applied to the new date provided availability permits. The rescheduled date must take place within one calendar year of the original booking.

In the event that rescheduling is necessary due to weather conditions or any other unforeseen circumstances, the new date must be mutually agreed upon by both the Photographer and the Client. The session will be transferred to the rescheduled date at no additional cost, subject to the Photographer’s availability.

4. TRAVEL AND LOCATION COSTS

Any fees or permits associated with the location chosen by the Client are to be paid directly by the Client.

Any mileage outside of the included travel range will be charged at a pre-agreed rate, as outlined in the quotation.

5. IMAGE DELIVERY

The Photographer will deliver edited images, usually within 30 working days from the session date. This may vary during peak periods.

Images will be delivered via online gallery. USBs or printed products (e.g., photobooks) are available at an extra cost.

Please note: RAW (unedited) files will not be provided. By booking, the Client agrees to the Photographer’s unique editing and artistic style.

6. COPYRIGHT & USAGE

The Photographer retains full copyright of all images created.

The Client grants the Photographer permission to use their images and likeness in any and all forms of media (including social media, website, advertising, and promotional materials).

If the Client prefers their images not be used for promotional purposes, this must be requested in writing at the time of booking.

7. LIABILITY

The Client agrees to hold the Photographer harmless for any personal injury that may occur during the session.

In the unlikely event that the Photographer is unable to deliver the final images due to unforeseen circumstances (such as technological failure or data loss through no fault of their own), liability is limited to the amount of the initial payment.
